Who Can Appeal?

A person who is dissatisfied with an eligible decision concerning their refugee status may have the right to appeal to the Appeal Tribunal for Refugees and Applicants for Refugee Status, in accordance with Rwanda’s applicable laws and procedures.
You may appeal if you are:

  • An applicant for refugee status whose application has been rejected by the competent authority at first instance.
  • A recognised refugee who is affected by an eligible decision concerning their refugee status and has a right of appeal under the law.
  • A person otherwise entitled to appeal under Rwanda’s refugee legislation and applicable procedures.

Important

  • An appeal must concern a decision that is appealable under the applicable law.
  • Appeals must be filed within the prescribed legal timeframe.
  • The appellant has the right to present relevant facts, evidence and legal arguments in support of their appeal.
  • Appellants may be entitled to legal assistance or representation, subject to the applicable procedures.
  • The Tribunal provides an independent and impartial review of eligible appeals.
  • The Tribunal does not determine refugee claims at first instance; its role is to review eligible decisions through the appellate process.
