How to File an Appeal
If you are dissatisfied with an eligible decision concerning your refugee status, you may have the right to appeal to the Appeal Tribunal for Refugees and Applicants for Refugee Status. Appeals are filed online through the Rwanda Integrated Electronic Case Management System (IECMS), in accordance with the applicable law and the Tribunal’s Rules of Procedure.
The online system enables appellants or their authorised representatives to submit appeals and supporting documents electronically, track the progress of their cases, and receive relevant notifications throughout the appeal process.
Steps to File an Appeal
- Obtain the decision: Obtain a copy of the first-instance decision that you wish to challenge and carefully review the reasons for the decision.
- Check your right to appeal: Confirm that the decision is appealable before the Appeal Tribunal and that you are within the prescribed time limit.
- Prepare your appeal: Clearly explain the reasons why you believe the decision should be reviewed. Identify any errors of fact or law, procedural concerns, or relevant evidence supporting your appeal.
- Prepare supporting documents: Gather the decision being appealed and any relevant documents or evidence supporting your grounds of appeal.
- File your appeal online: Submit your appeal and supporting documents through IECMS within the timeframe prescribed by law and the Tribunal’s Rules of Procedure.
- Receive confirmation: Once submitted, the appeal will be registered in accordance with the applicable requirements, and relevant information concerning the next steps will be communicated through the system.
- Participate in the proceedings: Attend the hearing where required and respond to requests from the Tribunal within the prescribed timeframes.
- Receive the decision: After considering the appeal, the Tribunal will issue its decision in accordance with the law and applicable procedures.
